Flashback Friday! - The Bad English Edition

Today's "Flashback Friday" is being posted a little late today, but still posted on Friday none the less. Bad English was one of those "super groups" that was formed from other members of bands much like how Power Station was formed, etc. This one is made up of singer John Waite who reunited with his keyboardist Jonathan Cain and bassist Ricky Phillips, from his first band "The Babys". The other member was Neal Schon who played with Jonathan Cain in Journey. Enjoy some Bad English!

Really? A 4-Year-Old Can Be Sued, Judge Rules In Bike Case

Can someone please explain to me how this can even happen? Our society and judicial system has gotten real crazy and what I call "sue happy" over the last 20 years for the stupidest things. And the even crazier part, is that judges are letting these certain kind of cases proceed.

I don't get how this judge rules the child is "not liable" yet is letting the other parties in the incident proceed with their lawsuit because there was "negligence" involved. WTF? The child is 4. She was on a bike with training wheels. It's NYC and it's crowded. Where else are the kids supposed to ride their bikes? I get that an elderly lady fell in the incident and later passed away, that sucks but come on. Everyone wants to sue for everything now days.

This also reminds of how in the OJ Simpson case, how he was acquitted in a state and civil trial, but yet he was found "liable" for the murders and ordered to pay $35 million to the victims families. How can you be NOT guilty and yet still liable?


NY Times:

Citing cases dating back as far as 1928, a judge has ruled that a young girl accused of running down an elderly woman while racing a bicycle with training wheels on a Manhattan sidewalk two years ago can be sued for negligence.

The ruling by the judge, Justice Paul Wooten of State Supreme Court in Manhattan, did not find that the girl was liable, but merely permitted a lawsuit brought against her, another boy and their parents to move forward.

The suit that Justice Wooten allowed to proceed claims that in April 2009, Juliet Breitman and Jacob Kohn, who were both 4, were racing their bicycles, under the supervision of their mothers, Dana Breitman and Rachel Kohn, on the sidewalk of a building on East 52nd Street. At some point in the race, they struck an 87-year-old woman named Claire Menagh, who was walking in front of the building and, according to the complaint, was “seriously and severely injured,” suffering a hip fracture that required surgery. She died three months later.

Her estate sued the children and their mothers, claiming they had acted negligently during the accident. In a response, Juliet’s lawyer, James P. Tyrie, argued that the girl was not “engaged in an adult activity” at the time of the accident — “She was riding her bicycle with training wheels under the supervision of her mother” — and was too young to be held liable for negligence.

In legal papers, Mr. Tyrie added, “Courts have held that an infant under the age of 4 is conclusively presumed to be incapable of negligence.” (Rachel and Jacob Kohn did not seek to dismiss the case against them.)

But Justice Wooten declined to stretch that rule to children over 4. On Oct. 1, he rejected a motion to dismiss the case because of Juliet’s age, noting that she was three months shy of turning 5 when Ms. Menagh was struck, and thus old enough to be sued.

Mr. Tyrie “correctly notes that infants under the age of 4 are conclusively presumed incapable of negligence,” Justice Wooten wrote in his decision, referring to the 1928 case. “Juliet Breitman, however, was over the age of 4 at the time of the subject incident. For infants above the age of 4, there is no bright-line rule.”

The New York Law Journal reported the decision on Thursday.

Mr. Tyrie had also argued that Juliet should not be held liable because her mother was present; Justice Wooten disagreed.

“A parent’s presence alone does not give a reasonable child carte blanche to engage in risky behavior such as running across a street,” the judge wrote. He added that any “reasonably prudent child,” who presumably has been told to look both ways before crossing a street, should know that dashing out without looking is dangerous, with or without a parent there. The crucial factor is whether the parent encourages the risky behavior; if so, the child should not be held accountable.

In Ms. Menagh’s case, however, there was nothing to indicate that Juliet’s mother “had any active role in the alleged incident, only that the mother was ‘supervising,’ a term that is too vague to hold meaning here,” he wrote. He concluded that there was no evidence of Juliet’s “lack of intelligence or maturity” or anything to “indicate that another child of similar age and capacity under the circumstances could not have reasonably appreciated the danger of riding a bicycle into an elderly woman.”

Mr. Tyrie, Dana Breitman and Rachel Kohn did not respond to messages seeking comment

Democrats Hope Jon Stewart Will Give Them Boost, Stage Phone Bank For The "Restore Sanity" Rally This Weekend

Remember, this weekend is The Colbert Report's (or as he pronounces it - The Coal Bear Re-pour) and Daily Show's staged "Restore Sanity" rally in DC. I wonder how many people will show up? They clearly claim that it is "non-partisan" but come on. We all know these guys are Democrats and it's all in fun to them because they are trying to make fun of the hugely successful Glenn Beck 8/28 rally he had. And the fact that it's staged only a couple of days before the elections is purely coincidental.

Facing dire prospects at the polls, Organizing for America, the permanent incarnation of the Obama presidential campaign, is looking for help from Saturday's Jon Stewart/Stephen Colbert "nonpartisan" rally on the Mall. "We need folks to turn the energy from that rally into action by contacting key voters across the country and making sure they have a plan to vote by November 2nd," Organizing for America officials say in a new email to supporters. "That's why we're holding a special phone bank just after the rally."

The phone bank will be held at Democratic National Committee offices near the Mall. "After the rally, come to the Democratic national headquarters to spread the sanity by calling voters in some of the country's closest races," an Organizing for America website says. "Food and drink will be provided."

"Stop the insanity! Make sure everyone votes on Tuesday."

Stewart claims his rally will be nonpartisan. "If we had to sum up the political view of our participants in a single sentence, we couldn't," he has said. "That's sort of the point."

President Obama, working to boost Democratic turnout next Tuesday, has endorsed the event. "[Jon Stewart] is going to host a rally called something like Americans in Favor of a Return to Sanity or something like that," Obama told an audience in Richmond, Virginia a few weeks ago. "And his point was, you know, 70 percent of the people, it doesn't matter what their political affiliation is, 70 percent of the folks are just like you, which is going about their business….having those voices lifted up is really important."

On Stewart's program Wednesday night, Obama was questioned about his administration's record and again brought up the rally. "You know, the other thing that might have made a difference is if you had held the Rally to Restore Sanity two years ago," Obama said. "That might have made a difference."

Everytime I get on the net or a site, there's another video of someone who is a liberal, union member, anti-American verbally or physically assaulting a Tea Party or GOP person. We knew the President wasn’t telling the truth back then. Every time the President promised “if you like the plan you have now, you can keep it” he was telling, at best, half the truth. Every time he said it was about “choice and competition” he was being dishonest. This was always a framework for change. Canadian-style single-payer is what they’ve always wanted and it’s what they still want.

We reached out to various reporters trying to get them to cover the story of the public option and explain to people why it was so important to liberals on Capitol Hill. Despite the fact that the public option was the center of the controversy for months, no one would touch it. And so, with the exception of a couple editorials and talk radio, no one informed Americans that health reform was, from its inception, designed to engulf the private system over time. Other than Glenn Beck’s show and a few other places, none of those video clips of people admitting the real plan ever appeared on TV. But now we have one final clip to add to our collection, the one above of the President admitting we were right.

President Obama says he’ll keep pushing to expand health control as long as he’s in office. That sounds like a great reason to make sure he only gets one term.

Now let me get this straight: George Soros, Media Matters, and the White House, in some unclear capacity, have unveiled their master plan to destroy the right: isolate and nullify Fox News by getting people fired from NPR.

NPR pink-slipped Juan Williams for the equivalent of stating that when he sees it's raining out, he gets his umbrella. NPR president Vivian Schiller, evidently divining that disparaging fears of Muslim terrorists wouldn't play well in a country that has suffered three serious terrorist attempts in a little over a year, added that this was merely the latest of a series of Williams outrages, but she produced no examples. (Schiller now says that she "regrets" how the firing was handled.)

Obviously, there has to be another reason, and when we look around, we find none other than the Prog Twins, Soros and Obama. (Not to forget David Brock...or is that the stupidest statement I ever typed?) Obama has been having bad dreams about Fox, so Soros contributes a cool $1.8 million to NPR for the purpose of hiring one hundred investigative reporters to learn the truth about Bigfoot. Another $1 mil went to Brock's Media Matters for the purpose, I imagine, of mixing more mud to fling -- they don't do anything else. Then, as soon as the checks cleared, Williams finds himself out on the street.

This is not a coincidence, comrades. This is the Alinsky isolate-and-destroy method in textbook form. A kindergarten textbook, granted -- the idea appears to be to prevent any further liberal contact with Fox, limiting the network to unbalanced right-wing voices, and then to sit back and wait for an aroused public to march on the Fox offices with pitchforks and torches. Of course it would happen just that way -- nobody would ever listen to Beck, Hannity, or Palin if NPR didn't encourage them.

The success of this plan can be gauged by the fact that everybody but Muslim Brotherhood front groups have condemned NPR; Williams has accepted a $2-million contract with Fox, where, as the last of the level-headed liberals, he's likely to feel much more at home; and Soros has found himself under far more public scrutiny than he's used to.

Boxer Avoiding The Media This Election Year, MSM OK With It

Again, one of the problems facing California: Barbara Boxer. DO NOT re-elect her. Read this piece I found on here on the site Red State. If a Republican avoided the media like she's been doing this election season, they'd be hounding that person left and right, upside down and backwards. Another example of MSM (mainstream media) bias.

Imagine if Sarah Palin promised reporters she’d take questions, then ran out from the event through the side door to avoid the questioning? Now imagine if Sharron Angle or Christine O’Donnell did it. The same shunned press would call them out for it and say they were fake or even avoiding accountability. Palin, of course, was accused of being entirely unqualified in part to avoiding high pressure press exposure, a charge Ginger Gibson is also leveling against O’Donnell.

Well, Babs Boxer has joined the club. I’m not expecting a rash of stories calling her an unqualified fake, seeking to avoid accountability for her 28 failed years in DC, though.

Do hope the media give us a bit more coverage of Mrs. Boxer’s attempts to avoid the media. After all, shouldn’t they be castigating her for ignoring them? I mean, if she had an (R) after her name, they’d be wondering what she’s trying to hide.

Boxer is desperate, so desperate she wants others to break the law to help her. So desperate that Barack Obama came out here twice to raise money for her. It’s time for the final push to beat her anyway.

The Rent Is Too Damn High!

Have you seen this guy? He is Jimmy McMillan and he is one of the 7 candidates running for New York Governor and he represents "The Rent Is Too Damn High Party". Now there is a doll made and named after him. This goes along with all the other political dolls that were made and sold during elections (read more about that on Right Pundits). SNL also did a funny skit on him on their Weekend Update segment last weekend that I though was funny. Here is a video of Mr. McMillan during the debate:

Liberal Gene Found

I can see this. I mean, we have genes in our body that determine all kinds of traits, mainly inherited so why not the political ones? I was raised in a family that pretty well split into thirds. 1/3 that were Conservatives, 1/3 Democrat and 1/3 that just didn't give a shit. So for me, it was pretty cool to get all views. I have friends and people that I grew up with that are now crazy liberal and now I can see why when reflecting and writing this opinion on the below article. Some of their parents were liberal and had a secret obsession with Clinton. Now look at us.

As I have said before, for the most part, I am more Conservative than anything, but as a person, an individual, I do have my own opinions about everything and I have voted for a couple of Non-Republicans in the past because I didn't like the candidate or their view. Ultimately, it's your own opinion and how you interpret things that you should make decisions. 9/10 times the Republicans are the way to go LOL.


Via NBC San Diego: Researchers have determined that genetics could matter when it comes to some adults' political leanings.

According to scientists at UC San Diego and Harvard University, "ideology is affected not just by social factors, but also by a dopamine receptor gene called DRD4." That and how many friends you had during high school.

The study was led by UCSD's James Fowler and focused on 2,000 subjects from the National Longitudinal Study of Adolescent Health. Scientists matched the subjects' genetic information with "maps" of their social networks. According to researchers, they determined that people "with a specific variant of the DRD4 gene were more likely to be liberal as adults." However, the, subjects were only more likely to have leanings to the left if they were also socially active during adolescence.

"It is the crucial interaction of two factors -- the genetic predisposition and the environmental condition of having many friends in adolescence -- that is associated with being more liberal,” according to the study.

"These findings suggest that political affiliation is not based solely on the kind of social environment people experience,” said Fowler, who is a professor of political science and medical genetics.

The researchers also said their findings held true no matter what the ethnicity, culture, sex or age of the subjects were.

Latest Polls Show More Americans Are Leaning To Republicans And The President Is Out Of Touch With 80% Of People

In some recent reports and on some blogs, it is reported that more and more are leaning towards Republicans and that the President is "out of touch" with 80% of Americans. That is disastrous for any President to be that far away from the people.

Matt Drudge has a brilliant picture of an ocean liner about to capsize with the caption “Gallup Sees Tidal Wave,” in a scene reminiscent of the classic 1972 disaster movie The Poseidon Adventure (the still may be from the film itself). I’ve frequently compared the Obama presidency to the Titanic, but perhaps an analogy with the fictional doomed SS Poseidon might be more apt, considering the scale of the Tsunami about to hit Washington on November 2nd and flip Congress upside down.

Gallup has another devastating poll which makes extremely grim reading for the White House today. Gallup’s polling shows that 48 percent of Americans now regard themselves as conservative, higher than each of the last three midterms, compared to just 20 percent who describe themselves as liberals. In addition, Gallup reveals that 55 percent of likely voters next week are Republican or lean Republican, in contrast to 40 percent who are Democrat or lean Democrat. Here are Gallup’s latest findings:


Gallup’s latest figures on the composition of the 2010 electorate suggest that, consistent with an earlier Gallup report, those voting in this year’s congressional elections across the country will be similar in gender, age, and education to 2006 voters. At the same time, they will be substantially more Republican in their party orientation, and more conservative than has been the case in the past several midterms.

Specifically, 55% of likely voters in Gallup’s Oct. 14-24, 2010, polling are Republicans and independents who lean Republican. This is higher than the Republican showing in the past four midterm elections, although not too dissimilar to the 51% found in 2002. The corollary of this is that the 40% of likely voters now identifying as Democratic is the lowest such percentage of the past several midterms.

With respect to political ideology, the 48% of likely voters now describing their political views as conservative is slightly greater than the 42% to 45% seen in each of the prior three midterms. However, the percentage of likely voters identifying as liberal has also generally increased over this period. Both changes are consistent with broader patterns Gallup has identified in the past year.


The poll underscores not only the huge advantage the Republicans have going into next week’s election, but also the sheer scale of the conservative revolution in America. As Gallup shows, conservatives now outnumber liberals by an almost 2.5 to 1 ratio. Liberals make up just 20 percent of the American population. Barack Obama is the most left-wing president in US history, and is clearly out of touch with at least 80 percent of the American people, who clearly do not share his ideology. Next Tuesday looks set to be an epic disaster for the Left in America, and the capsizing of the president’s Big Government dream.

Iran To Become Newest UN Women's Agency Board Memeber?

Are you serious? Iran? For women's rights? That's almost an oxymoron. This shows again how irrelevant the United Nations is getting.

Via The Jerusalem Post: Iran, where a woman convicted of adultery has been sentenced to death by stoning, is likely to become a member of the board of the new UN agency to promote equality for women, prompting outrage from the US and human rights groups.

Some rights groups are also upset that Saudi Arabia, where women are not allowed to drive and are barred from many facilities used by men, is also vying to join the governing body of UN Women.

The General Assembly resolution adopted in July that merged four UN bodies dealing with women's issues into a single agency with greater clout to represent half the world's population calls for a 41-member executive board, with 35 members chosen by regional groups and six representing donor nations.

The Asian group has put forward an uncontested 10-nation slate that includes Iran, UN diplomats said, and Saudi Arabia has been selected for one of two slots for emerging donor nations.

The 54 nations on the UN Economic and Social Council are expected to elect UN Women's board on Nov. 10, and it is possible that other Asian nations or emerging donor nations could become candidates though diplomats say it's not likely.

Mark Kornblau, spokesman for the US Mission, said Wednesday that Iran's membership "would send the wrong signal at the start of this exciting new initiative."

"UN Women is a vital new agency tasked with promoting gender equality and women's empowerment worldwide," he said. "We and many other countries are concerned by the negative implications of Iran's potential board memberships, given its poor record on human rights and the treatment of women.

"There are many qualified countries that would make positive and constructive contributions as board members," Kornblau said.

The stoning sentence against the 43-year-old woman, Sakineh Mohammadi Ashtiani, has raised an international outcry, embarrassing Iran.

A resolution adopted by the General Assembly last year expressed "deep concern" at Iran's increasing use of executions, death by stoning, torture, flogging and amputations, and its increasing discrimination against religious, ethnic and other minorities.

Philippe Bolopion, UN advocacy director for Human Rights Watch, said "it's puzzling that Iran would have the nerve to be a candidate for the board of UN Women, and even more puzzling if the Asia group lets Iran get away with it."

Connecticut Was Going To Ban WWE Shirts At The Polls, Now Says They Will Allow Voters To Wear The Shirts

I thought this was funny. The Connecticut Secretary of State was going to ban potential voters from wearing WWE merchandise and shirts when voting this year because the Senatorial candidate is former WWE Chairwoman Linda McMahon and was considering it was a conflict of interest sort of speak. Are you serious? Who cares? Is California going to ban people who shop on E-Bay or wear and E-Bay type logo from voting because Meg Whitman is running for Governor here? There are Left thugged people like the SEIU and The New Black Panthers doing fraud and voter intimidation but that's OK because it helps Democratic candidates and not Republican ones. I get it. At least they thought about it again and retracted saying you can wear a WWE shirt to the polls. What a joke.

Yahoo!/The Upshot: Connecticut Secretary of State Susan Bysiewicz is walking back a directive from her office that would have blocked voters from wearing World Wresting Entertainment clothing and memorabilia to the polls on Election Day.

In a statement to reporters Tuesday night, Bysiewicz said that her office's statement on WWE clothing had been misconstrued and that voters would not be turned away or asked to cover up WWE memorabilia on Election Day.

On Friday, a spokesman for the secretary of state's office told reporters that the office considered WWE garb too closely associated with former WWE Chairwoman Linda McMahon's Senate campaign. Therefore, the official explained, such attire would be considered a political statement in violation of state rules that limit politicking inside polling locations. Voters, the spokesman said, would have to cover up or remove the WWE garb or risk being turned away from the polls.

The Connecticut GOP and McMahon's campaign called the directive biased, and the WWE filed a federal lawsuit Monday calling the rule a violation of voters' First Amendment rights.

According to the Hartford Courant's Daniela Altimari, Bysiewicz said Tuesday that the matter had been overblown. In a letter to state officials Monday, the secretary of state said that "simply wearing WWE apparel at the polls" would not violate the law. But clothing bearing the name of McMahon or her campaign logo would not be allowed, Bysiewicz said.

"In preparing for this election, be advised that it is the position of this office that simply wearing WWE apparel at the polls, including apparel with the trade name or logo of the WWE or the name or photograph of any WWE entertainer that does not display the name or photograph of Linda McMahon ... or the name or logo of Ms. McMahon's campaign does not trigger a violation" of state election law, Bysiewicz wrote.

Piece On The Separation Of Church And State

This was an interesting piece I thought I would share. It comes from the site "America! Oh How We'll Miss You!". Check it out. It is about the separation of Church and State which is highly debated thing in this country. Especially over the last 10 years with all these groups and atheists suing for everything now.

I received an email today (recreated below) that prompted me to think about this question. When I researched to find out if the email represented fact, I found that it did. And then I began asking myself some questions. Here's the email.

This is a statement that was read over the PA system at the football game at Roane County High School , Kingston , Tennessee by school Principal, Jody McLeod

"It has always been the custom at Roane County High School football games, to say a prayer and play the National Anthem, to honor God and Country."

Due to a recent ruling by the Supreme Court, I am told that saying a Prayer is a violation of Federal Case Law. As I understand the law at this time, I can use this public facility to approve of sexual perversion and call it "an alternate life style," and if someone is offended, that's OK.

I can use it to condone sexual promiscuity, by dispensing condoms and calling it, "safe sex." If someone is offended, that's OK.

I can even use this public facility to present the merits of killing an unborn baby as a "viable! means of birth control." If someone is offended, no problem...

I can designate a school day as "Earth Day" and involve students in activities to worship religiously and praise the goddess "Mother Earth" and call it "ecology.."

I can use literature, videos and presentations in the classroom that depicts people with strong, traditional Christian convictions as "simple minded" and "ignorant" and call it "enlightenment.."

However, if anyone uses this facility to honor GOD and to ask HIM to Bless this event with safety and good sportsmanship, then Federal Case Law is violated.

This appears to be inconsistent at best, and at worst, diabolical.

Apparently, we are to be tolerant of everything and anyone, except GOD and HIS Commandments.

Nevertheless , as a school principal, I frequently ask staff and students to abide by rules with which they do not necessarily agree. For me to do otherwise would be inconsistent at best, and at worst, hypocritical... I suffer from that affliction enough unintentionally. I certainly do not need to add an intentional transgression.

For this reason, I shall "Render unto Caesar that which is Caesar's," and refrain from praying at this time.

" However, if you feel inspired to honor, praise and thank GOD and ask HIM,in the name of JESUS, to Bless this event, please feel free to do so.. As far as I know, that's not against the law----yet."

One by one, the people in the stands bowed their heads, held hands with one another and began to pray.

They prayed in the stands. They prayed in the team huddles. They prayed at the concession stand and they prayed in the Announcer's Box!

The only place they didn't pray was in the Supreme Court of the United States of America- the Seat of "Justice" in the "one nation, under GOD."

Somehow, Kingston , Tennessee Remembered what so many have forgotten. We are given the Freedom OF Religion, not the Freedom FROM Religion. Praise GOD that HIS remnant remains!

JESUS said, "If you are ashamed of ME before men, then I will be ashamed of you before MY FATHER.."

When I began researching the validity of this email I ran across a thread where a comment indicated the writer could not condone Jody McLeod's actions, claiming that "I do NOT endorse this lady. I cannot agree with the backdoor attempts to promote a particular religion to a captive audience (children, no less), especially from a bully pulpit of authority at a public school funded with public money."

So what "particular religion" was the writer referring to? Was Jody McLeod promoting Catholic religion? Protestant? Jewish? Mormon? Baptist? Jesuit? Lutheran? Which one? You see, the Constitution doesn't contrive to separate God from us, Only people have done that. The Constitution only contrives to prevent the government from imposing, with no choice, a certain religion on the people. When the founders created the Constitution they were aware of Allah and Buddha. They were aware of Ra and Zeus and all the other Greek and Egyptian gods. So if they were intent on eliminating any influence of a god on society, why did they add God into the founding documents? Why not be all-inclusive and add Allah and Buddha, and all the gods of the past, into the text? Because they were not interested in being inclusive. They understood that we would need a moral compass in which to navigate our existence if we were to survive. They believed that moral compass could be found in God, and it worked well for America until 1962. So what changed?

Although there had been attempts throughout our short history, it wasn't until 1962, in a Supreme Court decision in the Engel vs. Vitale case, that the assault on God in America took root. Until that time the Supreme Court ruled that matters of religion were matters for the state. It's interesting to note that the 1962 Supreme Court decision coincides with the beginning of America's social, moral, intellectual, and economic decline that brought us to the point we find ourselves today - in a fight to preserve liberty and freedom, or to slither into the socialist morass that engulfs many other countries.

If we don't insist that the Supreme Court stop "interpreting" the constitution and instead reverse obviously erroneous and ignorant decisions of the past 50 years, they are going to continue to legislate from the bench and we are all going to be in more serious trouble than we find ourselves today. Who would have thought that could be possible? The job of the Supreme Court is to tell us if something is Constitutional - period. Not to interpret based on individual ideology of the judges.

And we better legislate God back into every facet of our society soon by reversing past decisions, or our nation of freedom and liberty will be lost for good. The Federal Government and the Supreme Court will see to that. Stand up folks. Find the truth inside yourself. Do you believe in God? Do you need God? If the answer is yes, then you better be prepared to fight, because the battle of good vs evil is in full engagement. Believe it, or not. Time is short in terms of the window left open to us to recapture an America based on Christian values and liberty.

If you're good with letting the government take care of the masses, something clearly not intended by the founders; if your good with accepting the Constitution as a living document, something else clearly not intended by the founders, then please take the time to pack and get the hell out of America! We don't need or want you here any longer. Your way of thinking, and the men and women who believe that same way and who have acted on those beliefs, have done enough damage to our country.

Flashback Friday! - The Cure Edition

I asked my friends on Facebook for a suggestion to this weeks "Flashback Friday" to pick between Restless Heart, The Cure, Night Ranger and Bad English. Most said "The Cure". So here you go. This bad is awesome and probably could tag as the first "Emo" band. Some of these tracks are "live" because for some reason, the embedded code is disabled and when you do get the blogger code for it, it still comes up as "disabled" which is dumb.
